Welcome to Elkhorn Custom Apparel. These Terms & Conditions ("Terms") govern your use of our website and your purchase of products and services from Elkhorn Custom Apparel ("Elkhorn Custom Apparel," "we," "us," or "our").

By using our website, requesting a quote, placing an order, or purchasing products or services from us, you agree to these Terms.

1. Our Products & Services

Elkhorn Custom Apparel provides custom apparel and related products and services, including embroidery, printing, transfers, engraving, and other customization services.

Because many of our products are created specifically for each customer, the products, colors, garments, artwork, quantities, and other details of an order may vary depending on the selections and specifications provided by the customer.

We reserve the right to decline an order or request for any lawful reason, including where we believe the requested design or content may violate applicable law or the rights of another person or business.

2. Orders and Order Acceptance

An order is not considered accepted until Elkhorn Custom Apparel has accepted the order and, when applicable, received the required payment or deposit.

We may contact you to clarify order details, artwork, garment selections, quantities, or other specifications before beginning production.

We reserve the right to correct obvious pricing, typographical, or product-description errors and to contact you regarding any necessary corrections before processing an order.

For custom orders, production will begin based on the information and specifications approved or submitted by the customer.

3. Customer Responsibilities

You are responsible for reviewing your order carefully before production, including:

• Garment style and color

• Sizes and quantities

• Names, numbers, dates, and other text

• Artwork and design elements

• Spelling and wording

• Placement and other customization details

• Shipping and contact information

You are also responsible for ensuring that information and artwork provided to Elkhorn Custom Apparel is accurate and appropriate for production.

Unless otherwise agreed, customer-created designs and artwork are not routinely proofed by Elkhorn Custom Apparel before production.

If a customer approves a proof or design, the customer is responsible for reviewing and approving the information contained in that proof.

4. Customer-Supplied Artwork and Intellectual Property

You represent that you have the legal right to use any artwork, logo, photograph, design, trademark, name, likeness, or other material that you provide to Elkhorn Custom Apparel.

By submitting such materials to us, you authorize us to reproduce and use them as reasonably necessary to fulfill your order.

You remain responsible for obtaining any necessary permissions, licenses, or approvals for materials you provide.

Elkhorn Custom Apparel is not responsible for determining whether customer-supplied artwork or other content infringes the rights of another person or entity.

If we receive a complaint or believe that requested content may violate another party's rights or applicable law, we may refuse to produce the requested item.

5. Pricing and Payment

Prices for custom products and services may vary based on garment selection, quantity, decoration method, artwork, production requirements, and other factors.

Quotes are based on the information available to us at the time the quote is prepared and may be revised if the scope or specifications of an order change.

Payment terms, deposits, balances, and other billing requirements will be communicated at the time of ordering.

Orders may not enter production until required payment or deposit arrangements have been satisfied.

We reserve the right to pause or cancel production on accounts with unpaid balances.

6. Custom Orders, Cancellations, Returns & Refunds

Because custom products are made specifically for the customer, custom orders are generally final sale and are not eligible for return or refund due to changes of mind, incorrect size selection, incorrect garment selection, or customer ordering errors.

Cancellations or changes may be requested before production begins, but we cannot guarantee that changes or cancellations will be possible once an order has entered production.

If an order has already incurred costs for garments, materials, artwork preparation, production, or other services, those costs may not be refundable.

If there is a production error, defect, damage, or other legitimate issue with an order, please contact us so we can review the situation and determine an appropriate resolution.

7. Production Times and Shipping

Estimated production times are provided as estimates and are not guaranteed delivery dates unless expressly agreed otherwise in writing.

Production and delivery times may be affected by garment availability, supplier delays, equipment issues, weather, shipping delays, holidays, unusually large orders, or circumstances outside our reasonable control.

Once an order has been transferred to a shipping carrier, shipping delays are generally outside of Elkhorn Custom Apparel's control.

Customers are responsible for providing accurate shipping and contact information. We are not responsible for delays, additional costs, or lost shipments resulting from incorrect information provided by the customer.

8. Product Availability and Substitutions

Garment and product availability can change without notice. If a selected product becomes unavailable, we may contact the customer to discuss available alternatives.

Where an appropriate substitute is available, we will make reasonable efforts to communicate with the customer before making a material substitution.

9. Color, Appearance, and Finished Product Variations

Colors shown on a computer, phone, or other screen may differ from the actual color of a garment, thread, ink, transfer, or finished product.

Minor variations in color, placement, texture, thread coverage, print appearance, or other characteristics may occur as part of the normal production process.

Because custom products are produced using different materials and decoration methods, exact duplication of colors or placement across different garments or production methods cannot always be guaranteed.

10. Website Use

You may use our website for lawful purposes and in accordance with these Terms.

You may not:

• Use the website to engage in unlawful, fraudulent, abusive, or harmful activity

• Attempt to gain unauthorized access to our website, accounts, systems, or data

• Introduce malicious software or otherwise interfere with the operation of the website

• Copy, reproduce, modify, distribute, or exploit our website or its content without permission

• Use our website to infringe another person's intellectual property, privacy, publicity, or other legal rights

• Use automated systems to scrape, copy, or collect information from the website in a manner that interferes with its operation or violates these Terms

We reserve the right to suspend or restrict access to the website when reasonably necessary to protect our business, customers, website, systems, or other users.

11. Our Intellectual Property

Unless otherwise stated, the Elkhorn Custom Apparel name, logo, website, original graphics, photographs, written content, designs, and other materials created by us are owned by or licensed to Elkhorn Custom Apparel and may not be copied or used without permission.

Customer-supplied artwork remains the property of the customer or its respective owner.

Nothing in these Terms transfers ownership of intellectual property from one party to another except as expressly agreed in writing.

12. Finished Products and Photography

Unless otherwise agreed, Elkhorn Custom Apparel may photograph finished products for our internal records, portfolio, website, or marketing purposes.

We will make reasonable efforts to avoid publicly displaying customer names, personal information, or other confidential information without permission.

If an order contains confidential, proprietary, or otherwise sensitive information and you do not want finished products photographed or used for promotional purposes, please let us know before production.

13. Website Availability and Accuracy

We make reasonable efforts to keep our website accurate and available, but we do not guarantee that the website will always be uninterrupted, error-free, or completely current.

Product descriptions, pricing, availability, images, and other website information may occasionally contain errors or become outdated.

We reserve the right to correct errors and update website information at any time.

14. Third-Party Services

Our website and business may rely on third-party providers for services such as payment processing, website hosting, shipping, analytics, email communications, and other business functions.

We are not responsible for the independent acts, omissions, policies, or availability of third-party services.

Your use of third-party services may also be subject to those providers' separate terms and privacy policies.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Elkhorn Custom Apparel will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of our website or products or services.

Our liability relating to a specific custom order will generally be limited to the amount paid for that order, except where a greater remedy is required by applicable law.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

16. Indemnification

You agree to defend and hold harmless Elkhorn Custom Apparel and its owners, employees, and agents from claims, losses, damages, liabilities, and reasonable expenses arising from:

• Your violation of these Terms

• Your unlawful use of our website or services

• Artwork, content, or other materials that you provide to us

• Your violation of another person's intellectual property, privacy, publicity, or other legal rights

• Your failure to obtain appropriate authorization for materials submitted for production

17. Force Majeure

Elkhorn Custom Apparel will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, power outages, equipment failure, supplier shortages, shipping disruptions, labor disruptions, governmental actions, internet or telecommunications failures, or other events beyond our reasonable control.

18. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

19. Changes to These Terms

We may update these Terms from time to time as our business, website, services, or legal requirements change.

When we make changes, we will update the Effective Date at the top of this page. Your continued use of our website or services after updated Terms are posted constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

20. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from these Terms or your use of our website or services will be subject to the applicable courts and laws of Oregon, unless applicable law requires otherwise.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in effect.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other policies specifically incorporated by reference, constitute the agreement between you and Elkhorn Custom Apparel concerning your use of our website and services, except where a separate written agreement applies to a particular customer or order.
